tree preservation order (compensation)

Any person who applies for consent for works to trees subject to a TPO and who suffers loss or damage as a result of a refusal of consent may seek compensation from the Upper tribunal (lands chamber) provided that no article 5 certificate has been issued. In England, provisions for compensation are the same in all TPOs, whenever made, under the Town and Country Planning (Tree Preservation) (England) Regulations 2012.
